Guidelines for Supporting Decision Making by guardians & the others The guardian shall provide the person the information necessary for the decision-making in an easy-to-understand manner, suggest alternatives for deciding and support his/her the self-determination. ? A guardian cannot make a decision for himself or herself unless he or she has provided all practical support to make his or her decision. ? Even when the guardian makes a decision for himself/herself, there is a legal obligation to use the best interpretation of his/her wishes and preferences. ? If the guardian makes a decision in violation of the rule of respect for person’s will, it is ineffective due to abuse of guardian’s power. ? If the guardian violates the rule of respect for his/her will, he/she is responsible for including compensation for person’s damages.
